These General Terms and Conditions of Use (“Terms”) are an agreement (“Agreement”) between you and ClickStreet and covers your use of any information, software, products and services made available through ClickStreet.co.uk (or “ClickStreet”).
If you continue to use ClickStreet.co.uk as a guest, please be aware that neither ClickStreet nor its agents, employees and representatives, shall be liable to you or any other party for any losses or damages whatsoever or howsoever arising in connection with ClickStreet.co.uk (whether under these Terms or other contract or as a result of any misrepresentation, misstatement or tortious act or omission, including negligence).
By using the Website, you also represent and warrant that you are of legal age to form a binding contract and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use ClickStreet.co.uk. You are responsible for making all arrangements necessary for you to have access to ClickStreet.co.uk. You are also responsible for ensuring that all persons who access ClickStreet.co.uk through your internet connection are aware of these Terms and that they comply with them.

Buyer is the party that acquires or agrees to acquire, ownership of an item sold on ClickStreet.co.uk in exchange for money.
Seller or Merchant is a party that makes or offers to sell products or goods through ClickStreet.co.uk.
Worker or Freelance Worker: (Used interchangeably} is an independent contractor, tradesperson, taskers, professionals and other service providers who have subscribed to sell their services or products on ClickStreet.co.uk
Employer is a website user who purchases or seeks to purchase a service on ClickStreet.co.uk.
Service is the work or task offered by a Worker or Freelancer on ClickStreet.co.uk.
Item is a particular tangible or digital product offered by a Freelancer on ClickStreet.co.uk.
Pre-set Offer is the work or service offered by a Freelancer (who may or may not work exclusively on the project) at a pre-set price.
Service is a particular piece of work to be done or undertaken by a Worker on ClickStreet.co.uk.
Earning is the money obtained by a party in return for the service or item sold on ClickStreet.co.uk.
Extras Tasks are additional services offered on top of a Worker’s task for an additional price defined by the Worker.
Custom Order is the proposal made between an Employer and a Freelance Worker outside the job posting by the Worker on ClickStreet.co.uk.
Dispute is a disagreement between users on ClickStreet.co.uk.
RELATIONSHIP BETWEEN CLICKSTREET AND YOU:
(1) ClickStreet is NOT a store or an Employment Agency
ClickStreet.co.uk is an online marketplace platform for products sold by independent store owners and services performed by independent contractors, therefore ClickStreet.co.uk is only a VENUE. The marketing on the website or the information provided by ClickStreet along with the content on ClickStreet.co.uk related to services and products is provided for your private use and does not constitute a piece of advice from qualified Independent Contractors. We cannot guarantee that any information is correct, current or up-to-date, nor suitable for every situation.
Since ClickStreet is not a Store or an Employment Agency, please note that there is no contract between Workers, Buyers, Employer or Sellers and ClickStreet. Therefore, your use of ClickStreet.co.uk does not create an Employee/ Employer or Seller/ Buyer relationship between you and ClickStreet, or between you and any ClickStreet or Lexdot Limited employee or representative.
(2) ClickStreet is NOT an Introducer or a Referral Company
ClickStreet does not introduce or refer Employers or Buyers to you or recommend your business to Employers or Buyers. We do not attempt to put you and any particular Employers or buyer in touch with each other. The services and products sold on ClickStreet.co.uk are offers that may meet individual requirements posted by Freelance Workers and Sellers and advertised to the general public. If you need expert advice for your specific need, please consult a suitably qualified Independent Contractor or company. Neither ClickStreet nor any information provided on ClickStreet.co.uk is a substitute for a piece of advice from a suitably qualified Independent Contractor. ClickStreet’s publication of Independent Contractors is for your evaluation only and not an endorsement. ClickStreet does not endorse or recommend any Independent Contractor, nor does it make any warranty as to the qualifications or competency of an Independent Contractor.
RELATIONSHIP WITH MERCHANTS
Merchants selling their products on ClickStreet.co.uk are independent third parties. ClickStreet is not acting as a principal, agent or broker concerning any advertisers. Your relationship with any merchant you contact through this Website is solely between you and the merchant. You agree not to hold ClickStreet liable for any loss or damage of any sort incurred as the result of any business conducted with the merchants or as the result of the content provided by such merchants through the store on ClickStreet.co.uk.
ClickStreet makes no representation, guarantee, or warranty (express or implied) as to the legal ability, competence, or quality of representation which may be provided by any of the freelance worker, taskers or professional service providers which may be listed through the ClickStreet.co.uk.
NO JOINT VENTURE
You agree that no joint venture, partnership, employment, or agency relationship exists between you and us as a result of this Agreement or your use of ClickStreet.co.uk.
Our performance of this Agreement is subject to existing laws and legal process. Nothing contained in this Agreement is in derogation of our right to comply with governmental, court and law enforcement requests or requirements relating to your use of ClickStreet.co.uk or information provided to or gathered by us concerning such use.
If any part of this Agreement is determined to be invalid or unenforceable under any applicable law, including, but not limited to, the warranty disclaimers and liability limitations set out above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Agreement will continue in effect.
We may provide you with notices, including those regarding changes to the Terms by email, regular mail, postings on ClickStreet.co.uk, or other reasonable means now known or developed in the future.
A printed version of the Agreement, and any notice given in the electronic form, will be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this Agreement and all related documents have been drawn up in English.
There is no charge payable to ClickStreet for use of the Website during the continuance of these Terms and Conditions. TheNaira shall have no responsibility for transmission of funds due to any third party provider or distributor with whom you may elect to deal. You shall be responsible for transmitting all payments due on the terms agreed with any third party provider or distributor.
ClickStreet enables you to add content to the Website in the form of products, services, reviews or other features. ClickStreet shall be entitled, at its absolute discretion, to publish, edit, refuse, or delete content provided to it. ClickStreet will not knowingly permit the publishing of content that may be illegal under applicable law.
YOU CONSENT TO RECEIVE EMAILS
By creating an account, you agree that you may receive communications from ClickStreet.co.uk, such as special offers, account reminders and updates. You also understand that you can remove yourself from these communications by clicking the “Unsubscribe” link in the footer of the email.
LINKS TO THIRD PARTY WEBSITE
ClickStreet.co.uk may contain links to third-party resources and businesses on the Internet, called here “links” or “linked sites.” Those links are provided for your convenience to help you sponsor and is not legally associated with any third party linked sites. ClickStreet Limited is not legally authorised to use any trade name, registered trademark, logo or copyrighted material that may appear in the link.
ClickStreet does not control, endorse or monitor the contents of any Linked Site. That includes, without limitation, any further link contained in a linked website, and any changes or updates to a Linked Site. ClickStreet is not responsible for webcasting or any other form of transmission received from any linked website. These Terms do not cover your interaction with the linked website. You should carefully review the terms and conditions and privacy policies of any third-party sites.
If you use any service provided on a Linked Site, (a) ClickStreet Limited will not be responsible for any act or omission of the third party, including the third party’s access to or use of your customer data and (b) ClickStreet Limited does not warrant or support any service provided by the third party.
OWNERSHIP AND PRESERVATION OF YOUR MATERIAL
ClickStreet does not own any of the materials you provide to us (including feedback or suggestions) or post, upload, input or submit to any ClickStreet ClickStreet.co.uk or its associated services (collectively, your “Postings”).
By posting, uploading, inputting, providing or submitting your posts, you grant ClickStreet, its affiliated companies, and necessary sublicensees permission to use your postings in connection with the operation of their Internet businesses including, without limitation, the right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your posting; and to publish your name in connection with your posting. No compensation will be paid concerning the use of your posting. We are under no obligation to post or use any posting you provide and may remove any posting at any time at our sole discretion. By posting, uploading, inputting, providing, or submitting your Submission, you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.
We reserve the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in our discretion.
ACCEPTABLE USE OF CLICKSTREET.CO.UK
(i) No Unlawful or Prohibited Use
As a condition of your use of ClickStreet.co.uk, you will not use ClickStreet.co.uk for any purpose that is unlawful or prohibited by these Terms. You will not use ClickStreet.co.uk in any manner which could damage, disable, overburden or impair ClickStreet.co.uk, or interfere with any other party’s use and enjoyment of ClickStreet.co.uk. You will not obtain nor attempt to obtain any materials or information through any means not intentionally provided for on ClickStreet.co.uk.
The Content is protected by copyright and all other applicable Intellectual Property Rights set out above. Content is for your personal use only and not for resale. Your use of ClickStreet.co.uk does not entitle you to resell any Content from ClickStreet.co.uk. For the avoidance of doubt, your use of ClickStreet.co.uk constitutes your acceptance of these Terms and your promise that you will not resell or otherwise attempt to commercially benefit from the Content without our written express consent.
Our status (and those of any identified contributors) as the authors of material on ClickStreet.co.uk must always be acknowledged and you must not use the material in a derogatory manner. If you print off, copy or download any part of ClickStreet.co.uk in breach of these Terms, your right to use ClickStreet.co.uk will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
(ii) ClickStreet Community User Conduct and Protection
ClickStreet enables people around the world to create, share, sell, and purchase nearly any service they need at an unbeatable value. Services offered on ClickStreet reflect the diversity of an expanding Task economy. Members of the ClickStreet community communicate and engage through orders, social media, and on ClickStreet’s Community Forums.
ClickStreet maintains a friendly, community-spirited, and professional environment. Users should keep to that spirit while participating in any activity or extensions of ClickStreet. This section relates to the expected conduct users should adhere to while interacting with each other on ClickStreet. You agree to use the Communication Services only to post, send, and receive messages and material that are proper and related to the particular Communication Service. You agree that when using a Communication Service, you will not:
• defame, abuse, harass, stalk, threaten or otherwise breach the legal rights (such as rights of privacy and publicity) of others;
• publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information;
• upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control these rights or have received all necessary consents;
• upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer;
• advertise or offer to sell or buy any goods or services for any business purpose unless such Communication Service specifically allows such messages;
• conduct or forward surveys, contests, pyramid schemes or chain letters;
• download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner;
• falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;
• restrict or inhibit any other user from using and enjoying the Communication Services;
• breach any code of conduct or other guidelines which may be applicable for any particular Communication Service;
• harvest or otherwise collect information about others, including e-mail addresses, without their consent;
• upload or exchange of adult-oriented or pornographic materials and services;
• engage in bullying, harassment, and hate speech towards others. We allow users a medium for which messages are exchanged between individuals, a system to rate orders, and to engage on larger platforms such as our Community Forum and Social Media pages;
• publish or send malicious content with the intent to compromise another member’s account or computer environment is strictly prohibited;
• publish or post other people’s private and confidential information. Any users who engage and communicate outside of ClickStreet will not be afforded the protections specified in this Terms of Service;
• infringe and/or violate of third party’s terms of service;
• use ClickStreet for any unlawful purposes or to conduct illegal activities;
• have more than one active account. Any additional account determined to be created to circumvent guidelines, promote competitive advantages, or mislead the ClickStreet community will be disabled;
• engage in targeted abuse or harassment towards other users on ClickStreet.co.uk. This includes creating new multiple accounts to harass members through our message or ordering; system;
• breach any applicable laws or regulations.
We reserve the right, at our discretion, to review and remove materials posted to a Communication Service, in whole or in part. ClickStreet reserves the right to terminate your access to any or all of the Communication Services at any time without notice if we reasonably believe that you have breached these Terms or are misusing the Communication Services in any way.
Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. We do not control or endorse the content, messages or information found in any Communication Service and, therefore, we specifically disclaim any liability concerning the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not our authorised spokespersons and their views do not necessarily reflect our views.
Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction, and/or dissemination. You are responsible for keeping within these limitations if you download the materials.
We offer ways to communicate through the ClickStreet.co.uk network, community message boards, chat and forums. You agree to use those services as intended and not to post anything illegal or abusive.
Users may receive a warning to their account for violations of our Terms of Service or any user misconduct reported to our Trust and Safety team. A warning will be sent to the user’s email address and will be displayed for such a user on the Site. Warnings do not limit account activity, but can lead to your account losing Freelancer statuses or becoming permanently disabled based on the severity of the violation.
(iv) Reporting Violations
COPYRIGHT AND TRADEMARK NOTICE
ClickStreet is a subsidiary of Lexdot Limited, doing business as thenaira.com. Except as expressly provided, nothing within the Website shall be construed as conferring any license under our or any third party’s intellectual property rights, whether by estoppel, implication, waiver, or otherwise. Without limiting the generality of the foregoing, you acknowledge and agree that all content available through and used to operate the Website and its services is protected by copyright, trademark, patent, or other proprietary rights of ClickStreet and its affiliates, licensors, and service providers.
INTELLECTUAL PROPERTY INFRINGEMENT CLAIMS
It is the policy of ClickStreet to respond expeditiously to claims of intellectual property infringement. We will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws. Please contact us with the notice of any such infringement.
You must be very clear and thorough with your description, about the terms of the transaction and include information about the forms of payment you accept, any taxes or other applicable fees, postage method and costs, and your return policy. We reserve the right to reject, approve, or remove any listing for any reason at any time, at our sole discretion.
(i) Defined Tasks
A Freelance Worker may create Defined Tasks as products on ClickStreet to allow Employers to purchase their services, products, and technology. Tasks may be removed by ClickStreet for violations of these Terms of Service.
(ii) Extra Tasks
Extras tasks are additional services offered on top of the Freelancer’s Task for an additional price defined by the Freelancer. Extras Tasks may cover different categories of services that are components to a higher quality delivered service. Freelancer workers have the option to extend the duration of an order for each Task Extra that is added to the order. This is to cover the time needed to complete the extra service.
(iii) Custom Offer
Freelancer Workers can also send Custom Offers addressing specific requirements of an Employer. Custom Offers are defined by the Freelancer with the exact description of the service, the price, and the time expected to deliver the service. Custom Offers are sent from the conversation page. Services provided through Custom Offers may not violate ClickStreet’s Terms of Service.
Some of the services on ClickStreet are delivered physically (arts and crafts, collectable items, etc.]). For these types of Tasks, Freelancers may decide to add shipping charges. Freelancers/ Freelancers can add shipping charges for local shipping (within the same country) and international shipping (anywhere else).
Tasks that include shipping costs must have physical deliverables sent to Employers. Shipping costs added to a Task only pertains to the cost Freelancers require to ship physical items to Employers. Important: Employers who purchase Tasks that require physical delivery, will be asked to provide a shipping address. Freelancers are responsible for all shipping arrangements once the Employer provides the shipping address.
ClickStreet does not handle or guarantee shipping, tracking, quality, and condition of items or their delivery and shall not be responsible or liable for any damages or other problems resulting from shipping. A tracking number is a great way to avoid disputes related to shipping. We require entering the tracking number if available on the order page when delivering your work.
You may not offer direct payments to a Freelance Worker using payment systems outside of the ClickStreet recommended payment method or order system. Employers pay ClickStreet to purchase a task from a Freelancer Listing or Custom Offer, using the Order Now button. Additionally, Employers can request a Custom Order which addresses specific Employer requirements and receive a Custom Offer from Freelance Workers through ClickStreet.co.uk. Services or tasks may be purchased using a Credit Card or Paypal account.
If you have funds in your ClickStreet account balance, either from your shopping or available Earning balance, it will be automatically applied to your next purchase. You may not offer Freelancers/ Seller to pay or make payment using any method other than through the ClickStreet.co.uk site. In case you have been asked to use an alternative payment method, please report it immediately to us.
Employers and Buyers may be charged with indirect taxes (such as VAT or GST) depending on their residency, location, and any applicable law, in addition to the Task price shown on the Task page.
Once payment is confirmed, your order will be created and given a unique ClickStreet order number. A worker must deliver completed files and/or proof of work using the Deliver Work button (located on the Order page) according to the service that was purchased and advertised on their Task. Using the Deliver Work button may not be abused by Freelancers to circumvent Order guidelines described in this Terms of Service. Using the “Deliver Work” button when an order was not fulfilled may result in a cancellation of that order after review, affect the Freelancer’s rating and result in a warning to the Freelancer. Employer. An order will be automatically marked as complete if not rated and no request for modification was submitted within 3 days after marked as Delivered.
We encourage our Employers and Workers to try and settle conflicts amongst themselves. If for any reason this fails after using the Resolution Centre or if you encounter non-permitted usage on the Site, users can contact ClickStreet’s Customer Support department for assistance.
When an Employer orders a Service, the Freelance Worker is notified by email as well as notifications on the site while logged into the account. Workers are required to meet the delivery time they specified when creating their Tasks. Failing to do so will allow the Employer to cancel the order when an order is marked as late and may harm the Freelancer’s status, Freelance Workers must send completed files and/or proof of work using the Deliver Completed Work button (located on the Order page) to mark the order as Delivered.
Users are responsible for scanning all transferred files for viruses and malware. ClickStreet will not be held responsible for any damages which might occur due to site usage, use of content or files transferred. A Freelance Worker may cancel an order without the Employer’s consent at any given moment (Force Cancellation). However, this will harm the Freelancer/ Freelancer’s status.
Employers may use the “Request Revisions” feature located on the Order page while an order is marked as Delivered if the delivered materials do not match the Freelancer’s description on their Service page or they do not match the requirements sent to the Freelance Worker at the beginning of the order process.
Feedback reviews provided by Employers and Buyers when orders are completed is an essential part of ClickStreet’s rating system. Reviews demonstrate the party’s overall experience with the Freelance Worker or Seller and their service or product. Employers and Buyers are encouraged to communicate to the FreelanceWorker or Seller any concerns experienced during their active order in regards to the service provided by them. Leaving feedback is a basic prerogative of the party. Feedback reviews will not be removed unless there are clear violations of our Terms of Service.
To prevent any misuse of our Feedback system, all feedback reviews must come from legitimate sales executed exclusively through the ClickStreet.co.uk platform from users within our community. Purchases arranged, determined to artificially enhance Freelancer ratings, or to abuse the ClickStreet platform with purchases from additional accounts, will result in a permanent suspension of all related accounts.
Feedback comments given by Employers are publicly displayed on a Freelancer’s Task page. Employers have the option not to include a comment, but still rate the service. Cancellation of an order does not remove feedback unless mutually agreed. Work Samples are the delivered images and videos sent to an Employer in a delivery message. Work Samples are added to a Freelancer’s Live Portfolio on their Task page if the Employer chooses to publish the Work Sample while providing a public feedback review.
Withholding the delivery of services, files, or information required to complete the project with the intent to gain favourable reviews or additional services is prohibited.
Responding and posting a review: Once work is delivered, the Employer has three days to respond and post a review (or 14 days for Tasks with shipping). If no response is provided within the response period, the order will be considered completed.
Users are allowed to leave reviews on orders up to 30 days after an order is marked as complete. No new reviews may be added to an order after 30 days. Freelance Workers may not solicit the removal of feedback reviews from their Employers through mutual cancellations.
Sellers must stipulate the sore’s return policy and priority will be given to the published policy. Where the merchant or Seller fails to state the store’s Return Policy or where the stated Policy is vague, ClickStreet.co.uk Return Policy will apply.
DISPUTES AND CANCELLATIONS
We encourage all parties to try and settle conflicts amongst themselves. If for any reason this fails or if you encounter non-permitted usage on the Site, users can contact ClickStreet’s Administration.
Order cancellations can be performed on ClickStreet, when eligible, by Customer Support or through the Resolution Centre per order. Filing a transaction dispute or reversing a payment through your Worker or your bank is a violation of these Terms of Service. Doing so may get your account temporarily disabled to investigate possible security violations. Note: once you have filed a dispute with your Worker, the funds will be ineligible for a refund due to our obligations towards the Worker.
If an Employer or Worker encounters an issue related to the service provided in an order, you are encouraged to use the Site’s dispute resolution tools to attempt to resolve the matter. ClickStreet reserves the right to cancel orders or place funds on hold for any suspected fraudulent transactions made on the Website.
When applicable, all transfer and assignment of intellectual property to the Employer shall be subject to full payment for the Service and the delivery may not be used if payment is cancelled for any reason. If an order is cancelled (for any reason), the funds paid will be refunded to the Employer’s shopping balance. Revisions to deliveries can be performed by a Worker based on the Worker’s project and customer care. Freelance Workers may determine the number of revisions offered to an Employer, including no revisions.
Requests for revisions can be performed through the Order page while the order is marked as Delivered. Requesting to gain more services from Workers beyond the agreed requirements is not allowed.
ClickStreet encourages Employers and Freelancers to resolve service disputes mutually using the Resolution Centre. Eligibility for requests to ClickStreet to cancel an order will be assessed by our Customer Support team based on several factors, including violations to our Terms of Service, general misconduct, and improper usage of the ClickStreet.co.uk delivery system. Orders are not eligible to be cancelled based on the quality of service/materials delivered by the Freelancer if the service was rendered as described on the Task page. Parties must use ClickStreet Resolution Centre to address their concerns and desired resolution related to the service provided before contacting Customer Support.
Customer Support will not take any action against Orders where the Buyer or Employers failed to inform the Seller or Freelance Worker of issues related to their product or service and will allow them to provide a resolution first. This does not include non-permitted usage of ClickStreet. Any non-permitted usage of ClickStreet encountered during an Order, after being reviewed by our Customer Support team, may result in the order being cancelled. This includes, but not limited to; harassment, unlawful behaviour, or other violations of ClickStreet’s Terms of Service.
ClickStreet Customer Support will cancel orders based on, but not limited to, the following reasons:
(I) Active orders (after the Employer submits their requirements and before the Worker delivers on ClickStreet.co.uk)
• The Worker is late and unresponsive for more than 24 hours while the order is marked as Late.
• Users are abusive towards the other party through threats of low ratings or leveraging order materials (such as logins, personal information) against each other
• Users supplied or included copyright/trademark infringing materials as part of the Employer requirements or the Worker’s delivery.
• The user is no longer an active ClickStreet user due to Terms of Service violations or closure of their account.
(ii) Delivered Orders (after the Worker clicks Deliver Now and before the order is marked as complete)
• The worker uses the Delivery system to extend the delivery due date to complete the requested service without providing the final delivered service to Employers.
• The Worker delivers no files and/or proof of work related to the agreed-upon order requirements.
• The Worker requests additional payments, on or off the ClickStreet platform, by withholding the final delivery of services directly related to the agreed requirements.
• The Worker is withholding the final delivery of services for improved ratings.
• Employers who abuse the Request Revisions button to gain more services from Workers beyond the agreed requirements.
• Employers who threaten to leave a damaging review to gain more services from the Freelancer not related to the agreed requirements.
(iii) Completed Orders (after the order is marked as complete and before the 14-day limitation) ClickStreet Customer Support will review cases of Order delivery.
ClickStreet does not automatically refund payments made for cancelled orders back to Buyer or Employer. For services, funds from order cancellations are refunded to the Employer’s balance as credit and are available for future purchases on ClickStreet. Funds returned to your balance from cancelled orders will not include processing fees paid.
Deposit refunds, when available from the payment Freelancer, can be performed by our Customer Support team. To prevent fraud and abuse, we limit the total amount of times users can request a payment refund from their account which is subject to review by our Customer Support Team. Such refunds may be subject to an additional fee.
